The reasons why mediation is required varies from case to case and judge to judge, but they know the benefits of having a mediator in divorce cases and will most likely give preference to those who wish to mediate versus litigating.

According to a Boston divorce attorney, there are several common instances in which mediation is required in divorce cases. Divorce mediation sessions involve the divorcing couple and their lawyers. The mediators act as neutral third parties who facilitate discussions to help the divorcing couple arrive at an agreement on all of the important issues related to parenting, property, and finances. If both spouses can’t agree on any topic, then one party must go before a judge.

The best way to resolve conflict with a stubborn spouse is through mediation, which is a process in which two or more parties work out their differences with the help of a neutral mediator. Mediation is voluntary and allows people on both sides of an argument to hear each other’s point of view during delicate times.

This is because many parents will claim that they deserve to have custody of their child, even if it means hurting the child by making them choose one parent over the other. Many divorces in Massachusetts involve the division of marital home equity. However, there may be circumstances where both parties cannot agree on price and sale terms. Mediation is required for divorce cases involving marital homes in Boston. The only solution for couples who cannot arrive at an agreement via negotiations will be through mediation sessions with a qualified mediator.
